TERMS AND CONDITIONS

These terms and conditions govern the Natvia x Sunbeam 2025 Healthy Habits Giveaway. All other information provided prior to entering the competition, including instructions on how to enter the competition, form part of these terms and conditions. By entering, participants accept and agree to abide by these terms. Any entry not complying with these terms will be deemed invalid. 

 

HOW TO ENTER

To enter the Natvia x Sunbeam Giveaway on Instagram: 

1. Follow @natvialiving and @sunbeam_anz on Instagram. 
2. Comment on the giveaway post, tagging three friends. 
3. Multiple entries are allowed, provided each entry tags different users. 
4. Entrants must have a public Instagram profile.

WHO CAN ENTER

The giveaway is open to residents of Australia and New Zealand. 

Entrants under 18 years old must have parental or guardian consent, and the parent/guardian may need to confirm consent.  Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.

Employees of Natvia, Sunbeam, or affiliated agencies, and their immediate families, are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

The Promoter reserves the right to verify the authenticity of entries and the eligibility of entrants at any time, including confirming identity, age, and place of residence. Any entry that does not comply with these Terms and Conditions or involves tampering with the entry process may be disqualified. The Promoter may accept errors and omissions at its discretion, and any failure to enforce its rights does not constitute a waiver. Entries that are incomplete or illegible will be considered invalid.

Entrants agree that their submissions must not contain content that is obscene, defamatory, threatening, harassing, hateful, racially or ethnically offensive, or that promotes illegal activity, incites civil liability, or violates any law.

By entering, entrants confirm they have the authority to participate and indemnify the Promoter against any costs or damages arising from breaches of these Terms and Conditions.

 

HOW TO WIN

To enter the competition, the entrant must like the post, follow both @natvialiving and @sunbeam_anz on Instagram.

The winner of the prize drawn is determined as a game of chance. The winner shall be selected at random by NATVIA IP PTY LTD and will be announced per announcement date in the competition period of these terms.

Entrants who are not winners will not receive any notification at all. The winners shall be notified via Instagram comment on the competition post, a direct message and Instagram story.

• End Date: 27 January 2025, 11:59p.m. (AEDT)
• Winner Announcement: 3 February 2025, 10:00 a.m. (AEDT)

The prize will be shipped via post or courier.

If the winner does not claim the prize by 3 March 2025, the Promoter may award it to an alternate entrant selected randomly. 

 

EXCLUSION OF LIABILITY

If the competition is disrupted or cannot proceed as planned due to circumstances beyond the Promoter’s reasonable control, the Promoter reserves the right, at its sole discretion and to the extent permitted by law, to (a) disqualify any participant or (b) modify, suspend, terminate, or cancel the promotion, subject to any instructions from regulatory authorities. 

Entrants are responsible for any costs incurred when accessing Facebook, Instagram, or related mobile applications, which depend on their chosen Internet service provider. The use of automated tools or any mechanical or electronic methods to submit multiple entries is strictly prohibited and will result in the disqualification of all entries submitted by the offending participant. 

To the extent permitted by law, the Promoter (including its employees, agents, and representatives) disclaims all liability for any personal injury, loss, or damage (including indirect, special, or consequential losses) arising from the competition. This includes, but is not limited to: 

(a) technical malfunctions or equipment failures beyond the Promoter’s control; 

(b) theft, unauthorized access, or third-party interference; 

(c) delayed, lost, altered, or misdirected claims or entries due to circumstances outside the Promoter’s control; 

(d) discrepancies between the stated and actual prize value; 

(e) tax obligations incurred by the winner; and 

(f) any use of the prize. 

The Promoter and its affiliates are not liable for any delay or failure in fulfilling their obligations due to acts of God, war, natural disasters, strikes, illnesses, accidents, civil unrest, or other unforeseen events outside their control.

 

PRIVACY AND CONSENT

By entering, participants consent to the Promoter using their details solely for administering the giveaway. Winners may need to provide additional information for prize delivery. 

 

GENERAL TERMS

1. Entries must not contain offensive, defamatory, or unlawful content. 
2. Automated entries or entries submitted through mechanical means are prohibited. 
3. The Promoter’s decisions on all matters relating to the giveaway are final. 

 

LOSS

If the Promotion cannot proceed as planned due to factors beyond the Promoter's control—such as computer viruses, network failures, bugs, tampering, unauthorized intervention, fraud, or technical issues—the Promoter reserves the right, at its sole discretion and in accordance with applicable regulations, to cancel, terminate, modify, or suspend the Promotion. This may include invalidating affected entries or altering the prize as necessary. 

The Promoter has the right to verify the authenticity of entries and the eligibility of participants, including their identity, age, and place of residence. If a winner fails to provide adequate proof of eligibility when requested, they will forfeit the prize, and no substitute will be offered. The Promoter may deem entries incomplete, indecipherable, inaccurate, or offensive as invalid and ineligible to win. Entries that violate laws, infringe on third-party rights (including intellectual property), or use automated software or electronic means to submit repeated entries may also be disqualified. 

Non-compliance with the competition's terms and conditions can result in disqualification. In case of disputes regarding the Promotion’s operation or the awarding of prizes, the Promoter will work directly with the entrant to resolve the issue. If no resolution is reached, the Promoter’s decision will be final. 

The Promoter and its associated entities are not responsible for any loss, including indirect, special, or consequential losses, as well as damages, expenses, personal injury, or death arising from participation in the Promotion or the acceptance or use of any prize. This exclusion does not apply where such losses or injuries result from the Promoter’s own actions or are otherwise legally unavoidable. In such cases, the Promoter’s liability is limited to the minimum extent permitted by law.

 

DISQUALIFICATION
The Promoter retains the authority to cancel, postpone, or adjust the promotion if unforeseen circumstances or technical difficulties make it unfeasible to proceed as planned. Entries that are incomplete or unclear may be disqualified. In the event of any disputes concerning the promotion's operation or prize claims, the Promoter's decision will be final.

These Terms and Conditions shall be governed by the law of Victoria, Australia.
